Non-application & Time of Day
Division III (the 703/704/705 fatigue rules) doesn't apply to 702 aerial work or to medical evacuation flights. And every "time of day" in the Division is read at your acclimatized location.

What Division III doesn’t cover
The fatigue rules in Division III (CARs 700.19–700.72 — the ones this site is mostly about) don’t apply to (700.19(1)):
- 702 aerial-work operations — those have their own fatigue rules in Division X of Subpart 702; or
- medical evacuation flights — covered by Division IV of Subpart 700 (the 700.100 series).
If your operator holds certificates for more than one subpart, the fatigue rules for the subpart a given flight is operated under apply for that whole flight (AC 700-047 § 4.1).
“Time of day” means acclimatized local time
Every reference to a clock time in Division III — start times, the window of circadian low, the 22:30–09:30 local night’s rest window, and so on — is read at the location you’re acclimatized to (700.19(2)). If you’re not acclimatized where you are, it’s the local time back at the last place you were acclimatized. This is the same principle behind the 700.28 table lookup.

700.19 (1) This Division does not apply
- (a) to an air operator who operates an aircraft under Subpart 2 of this Part or to a flight crew member who operates an aircraft under that Subpart; or
- (b) to an air operator who conducts a medical evacuation flight or to a flight crew member who operates an aircraft to conduct such a flight.
(2) For the purposes of this Division, references to a time of day are
- (a) if a flight crew member is acclimatized, references to the local time at their location; or
- (b) if a flight crew member is not acclimatized, references to the local time at the last location where the member was acclimatized.
